TERMS AND CONDITIONS
1 – Acceptance of the general sales conditions
This contract is a distance contract pursuant to art. 50 et seq. Of Legislative Decree 6 September 2005, n. 206 (“Consumer Code”). These terms and conditions govern the contract concerning the sale of the products offered on the website www.re-nato.it between Just Values m & amp; sas, owner of the brand Vintage Re-nato, based in Rimini, via Bertola, N ° 30, Cod.Fisc./Part. VAT 04099700405 and the consumer (hereinafter “Customer”). The Contract which has as object the sale of products offered between Just Values sas and Client shall be considered concluded with the acceptance, even if only partial, of the order by Just Values sas. The purchase of products and services online implies full acceptance without reservation to these general sales conditions (hereinafter “General Conditions”).
The General Conditions will remain valid and effective until they are modified and / or supplemented by Just values sas. Any changes and / or additions to the General Conditions will be effective from the date on which they will be published and will apply to sales made from that date.
Once the purchase procedure has been completed, the Customer is required to print or save an electronic copy of these General Terms and Conditions of Sale.
2 – How to buy
The Customer can only purchase the Products present in the Vintage Re-nato electronic catalog (hereinafter the “Products” or the “Product”) at the time the order is forwarded and can be viewed online as described in the relevant information sheets. It is understood that the image attached to the description of a Product may not be fully representative of its features but may differ in color, size, possibly present in the figure. Furthermore, the Customer acknowledges that the product for sale is used and therefore may show normal signs of wear. The correct receipt of the order is confirmed by Just Values sas by means of an e-mail reply, sent to the e-mail address communicated by the Customer during the purchase.
The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. In case of non-acceptance of the order, Just Values sas guarantees timely communication to the Customer.
Just Values sas reserves the right to cancel orders considered to be unreliable without prior notice. In such circumstance, if the Customer has made the payment and this proves to be already accredited, Just Values, will proceed to the immediate cancellation of the total amount of the order.
3 – Payment methods
All prices include VAT and are displayed next to each product.
Prices on the website www.re-nato.it may be subject to change without notice.
Just Values provides different payment methods:
3.1 Credit / Debit Cards – Pay Pal
Secure Payments . We use the PayPal circuit which allows you to pay with all credit cards safely and quickly. It is not necessary to have a PayPal account , just any credit / debit card (even postepay).
If the customer has a Paypal account, he can choose to use the latter.
No archive of Just Values contains, nor does it contain, data relating to Credit / Debit Cards. These data pass over a secure connection only at the time of payment.
3.2 Payment on Delivery
Payment in cash to the courier upon delivery. Payment on delivery includes an additional cost that will be calculated in the total order.
3.3 Withdrawal on site
The goods purchased and already paid for by Credit / Debit Card can be withdrawn by the Customer at the Re-Nato store (avoiding shipping costs).
4 – Delivery Methods and Expenses
The delivery of the products requested at home will be by express courier. For shipments to Italy, the goods will be delivered to the address indicated for the shipment upon payment of a contribution of € 7.00 including VAT for a charge of less than € 100.00. For purchases whose amount is equal to or greater than € 100.00 the shipping costs will be free. It is required to accurately report all the data of the shipping address (including the name on the intercom, or specific indications that can facilitate the delivery) and of a telephone contact to prevent the package from being delivered.
For shipments to other European countries, the contribution for shipping costs is € 12.00.
Delivery times for Italy, except for areas that are difficult to reach, are approximately 24 hours and in any case not more than 2/3 working days, excluding the day of the order, but may vary at the courier’s discretion based on areas. The aforementioned times are indicative and not binding, in case of adverse weather conditions or strikes Just Values cannot be held responsible for delays and disruptions by the courier.
Once the shipment has started and has just been made available on the courier website, you will receive an email with the Tracking Number required to follow the shipment at each stage. If at the time of delivery you are not present in the place indicated by you, the courier will contact you to fix a new delivery, after which in case of non-delivery the goods will go into custody at the branch of the reference express courier and in this case for the withdrawal must be paid a surcharge which will be at your sole charge. If the goods cannot be delivered due to unavailability of the recipient or for other reasons not attributable to Just Values or the courier, all further transport costs, stocks, packaging, miscellaneous expenses will be charged to the buyer.
Once received the product it is important to verify that:
– the number of packages (packages) indicated on the carrier’s letter is effectively the one delivered;
– that the package is intact and not damaged; any disputes must be immediately raised to the courier by the Customer who must affix in writing on the copy of the document that remains to the courier the wording “RESERVE OF CONTROL”, specifying in the most detailed way possible the motivation: the type of damage, the package number etc. .. otherwise the product is considered delivered correctly. Just Values is not responsible in any case for damage not reported following the aforementioned procedure. Any problems concerning the physical integrity, correspondence or completeness of the Products received must be reported within 7 days of delivery by contacting Just Values who will open a case for the possible replacement of the goods.
In the event of damaged goods, in order to verify the presence and extent of damage to the Products caused by transport, everything must necessarily be documented with a photograph in digital format, to be attached to the communication addressed to Just Values together with the scan of the bulletin of the courier with the specifications of the reserve. In any case, no responsibility can be attributed to Just Values in case of delay in the execution of the order or in the delivery of the order.
5 – Right of Withdrawal
Under the Consumer Code, if the Customer is a consumer, he has the right to withdraw from the Purchase Agreement for any reason, without needing to provide explanations and without any penalty. Products ordered specifically for the customer are exempt. Within 10 days from the delivery of the goods it is possible to ask for their return and to obtain a refund of the purchase price. The Right of Withdrawal is not permitted to legal persons (eg companies, retailers, etc.) and to natural persons acting for purposes related to their commercial activity. To exercise the Right of Withdrawal, the Customer will simply have to send Just Values a notice within 10 days from the date of receipt of the goods. The communication must be sent by registered letter with return notice to Just Values sas, via Bertola 30 – 47922 – Rimini.
Once the withdrawal notification has been received, Just Values will quickly inform the Customer of the instructions for returning the Products, which must take place within 10 working days of receipt of the instructions; the costs of the redelivery will be totally charged to the Customer, as well as the cost incurred for the first delivery of delivery, which will not come
refunded.
In order for Just Values to accept the return request, the following conditions must be met:
5.1 The shipping costs (both outbound and in a possible return) are always charged to the Customer;
5.2 The products must be in the same condition as shipped and must be packed in their original packaging; the goods must not have been altered in any way;
5.3 The shipment, up to the certificate of receipt at the Vintage Vintage, is under the full responsibility of the Customer;
5.4 In the event of damage to the goods during transport, Just Values will inform the Customer;
5.5 Just Values is not responsible in any way for damage, theft or loss of returned Products;
5.6 On arrival at Re-nato Vintage the Product will be examined to assess any damage or tampering not deriving from transport. If the original packaging and / or packaging is damaged and the product used or tampered with, the Customer will forfeit the Right of Withdrawal as indicated below.
Having ascertained the good condition of the returned products, within 10 days of receipt of the goods, Just Values will proceed with a refund by bank transfer. It is the Customer’s responsibility to provide the bank details on which to obtain the reimbursement (Cod. ABI – CAB – Current Account of the invoice holder).
In the event of forfeiture of the Right of Withdrawal, Just Values will return the purchased good to the Customer, charging him the shipping costs and will not proceed with the repayment of the price paid.
5.7 Force Majeure
Just Values will not be considered in default of its obligations if the performance is delayed due to a Force Majeure event. For Force Majeure means any event beyond the reasonable control of Just Values, such as: natural events, terrorist acts, storms, floods, fires, riots, acts of sabotage, prohibition of trade, strike, energy suspension, breakdown of equipment, transport delays due to the same causes reported here as Force Majeure, orders from the civil authorities, acts, regulations, ordinances, of any government authority, acts of war, interruptions of the Internet service, acts or omissions of the Customer . The contractual deadlines are postponed for the time necessary to overcome the consequences of a Force Majeure cause.
5.8 Intellectual Property
All information provided and, more generally, all or part of www.re-nato.it itself, is reserved and protected. It is forbidden to reproduce trademarks and logos in use on www.re-nato.it. the Customer also undertakes not to copy, modify, translate, reproduce, disseminate, sell, publish, enhance and disseminate all or part of the information (even partial) present on the Site.
5.9 Customer obligations
The Customer declares and guarantees the following:
– To be a consumer according to the provisions of art. 3 of the Consumer Code;
– To be of age;
– that the data supplied by the same for the execution of the Contract are correct and truthful.
